Notice:  Under Pa.R.Crim.P 506, your complaint may require approval by the attorney for the Commonwealth before it can be accepted by the magisterial district court.  If the attorney for the Commonwealth disapproves your complaint, you may petition the court of common pleas for review of the decision of the attorney for the Commonwealth.

 

WE, do hereby state:

            We accuse the above named defendants who are located at the addresses set forth above with violating the penal laws of the Commonwealth of Pennsylvania at Franklin Mills Mall, 1455 Franklin Mills Circle, Philadelphia, PA, in Philadelphia County beginning on or about August, 2008. 

 

The acts committed by the accused are:

 

THAT, the Army Experience Center, a recruiting station for the United States military on its premises contains games and real weapons as well as “war engagement” simulators that attracts underage youth (the demographic target of military recruiters) to simulate engagement in acts of war and violence  without knowledge of the real consequence of said actions in reality and without parental consent required by law; and

THAT, the Army Experience Center is therefore involved in “Endangering the Welfare of a Child” and “Criminal Solicitation of a Minor” and “Corruption of Minors” – soliciting underage persons to act in a violent manner and thereby supporting criminal and corrupt behavior, 55 Pa. Code Sec. 3940.4, and also Sec. 6301, and generally 18 Pa C.S. Sec. 4304, which does not mandate an inference of physical abuse and which is a general charge of alleged child abuse; and

            THAT, the Army Experience Center was established as lessee in August, 2008, at a cost to the taxpayers of $12 million in the Franklin Mills Mall, with the full knowledge of the said lessor, of the nature and purpose of the Army Experience Center, which said defendant, Franklin Mills Mall, is also complicit in 55 Pa. Code Sec. 3940.4, and also Sec. 6301 and generally 18 Pa C.S. Sec. 4304, which does not mandate an inference of physical abuse and which is a general charge of alleged child abuse; and

            THAT, the Franklin Mills Mall, lessor to the Army Experience Center, is owned and operated as part of the Simon Property Group, which said defendant is also complicit in 55 Pa Code Sec. 3940.4, and also Sec. 6301 and generally 18 Pa C.S. Sec. 4304, which does not mandate an inference of physical abuse and which is a general charge of alleged child abuse; 

The complainants in this criminal complaint do hereby allege:

THAT, the Army Experience Center, residing in the Franklin Mills Mall, located in Philadelphia County, Pennsylvania, and within the propriety of the Simon Property Group, is involved in the “Criminal Solicitation of Minors” – soliciting of persons to become part of the U.S. Army that are underage and are thereby considered “Minors” under the laws of this Country and under International Laws established by Principle VI of the Nuremberg Principles, to wit, to participate in a crime against the peace; stating:

            Principle VI

            The crimes hereinafter set out are punishable as crimes under international law:

(i)             Planning, preparation, initiation or waging of a war of aggression or a war in violation of international treaties, agreements or assurances;

(ii)           Participation in a common plan or conspiracy for the accomplishment of any of the actions mentioned under (i).

To engage in conduct that promotes the planning and solicitation of youth, that would allow those being solicited to constitute the contravention of International Law, as established in the Geneva Conventions, the Nuremberg Principles, and the UN Charter prohibiting wars of aggression as a crime against humanity; and

The Franklin Mills Mall, and its parent organization, the Simon Property Group, was before establishment of the Army Experience Center, and continues to be fully knowledgeable of the nature and efforts of the Army Experience Center, making said parties accessories before and after the fact. 

FURTHERMORE, being that Franklin Mills Mall is considered a privately owned and operated premises, which knowingly has allowed the construction of a federally owned and operated “storefront” catering to the seduction of minors by inducing said minors to witness and participate in acts of violence through the simulators constructed with actual weapons and armored vehicles initially built and meant for combat in a warzone, paid for by United States Federal funds from the taxpayers, which is established in and on the premises of the Army Experience Center thereby violating the rule of law.

All of which are against the peace and dignity of the Commonwealth of Pennsylvania and contrary to the Act of Assembly, or in violation of above stated statutes.

We ask that the process be issued and that the defendants be required to answer the charges heretofore made.

We verify that the facts set forth in this complaint are true and correct to the best of our knowledge or information and belief.  This verification is made subject to the penalties of Section 4904 of the Crimes Code (18 PaC.S.Sec.4904) relating to unsworn falsification to authorities.
